PhotoRepair Terms of Use

Please read these Terms of Use (“Terms”) carefully before using the PhotoRepair mobile application (“App”). By downloading, installing, or using PhotoRepair, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By accessing or using PhotoRepair, you confirm that you are at least 13 years of age (or the minimum age required in your jurisdiction) and that you accept these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use PhotoRepair for your personal or internal business purposes, subject to these Terms and the Apple Media Services Terms. This license does not allow you to:

• Copy, modify, distribute, sell, or lease any part of the App.
• Reverse engineer, decompile, or attempt to extract the source code or AI models, except where permitted by law.
• Use the App for any unlawful, infringing, or harmful purpose.

3. Local Processing and Your Content

PhotoRepair processes your photos and image data entirely on your device. All editing, restoration, enhancement, and AI processing run locally, and your photos are never uploaded to or stored on our servers. You retain full ownership of all images you create, import, or edit using the App (“Your Content”). You are solely responsible for Your Content and for ensuring you have the rights necessary to edit and use it.

4. Acceptable Use

You agree not to use PhotoRepair to:

• Create, edit, or distribute content that is illegal, defamatory, obscene, or that infringes the intellectual property, privacy, or other rights of any third party.
• Generate misleading, deceptive, or fraudulent imagery, including content intended to impersonate others or spread misinformation.
• Remove watermarks, copyright notices, or metadata from images you do not own or have permission to modify.

You are solely responsible for how you use the App’s tools, including object removal, background editing, restoration, and metadata removal features.

5. In-App Purchases and Subscriptions

PhotoRepair offers optional Premium features through in-app purchases, including auto-renewing subscriptions and a one-time Lifetime purchase.

• All purchases are processed by Apple through the App Store. We do not collect or have access to your payment information.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel subscriptions in your App Store account settings.
• Except where required by law, payments are non-refundable. Refund requests are handled by Apple in accordance with its policies.

6. Intellectual Property

The App, including its software, design, AI models, trademarks, and branding, is owned by us or our licensors and is protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other proprietary materials except as expressly permitted herein.

7. Third-Party Models and Components

PhotoRepair incorporates third-party and open-source AI models and libraries, each governed by its own license. Your use of the App is also subject to those licenses where applicable. We make no warranties regarding third-party components.

8. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or that processing results will meet your expectations. AI-generated or AI-edited results may contain inaccuracies or artifacts.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, or profits, arising out of or related to your use of the App. Because all processing occurs on your device, you are responsible for maintaining backups of your original photos. Our total liability for any claim shall not exceed the amount you paid for the App, if any, in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. Upon termination, the license granted to you ends, and you must stop using the App. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted within the App or on our official website, and the “Effective Date” will be updated accordingly. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law, without regard to conflict-of-law principles. Any disputes shall be resolved in the competent courts of the applicable jurisdiction.
