Who We Are
Dajiale (listed on the App Store) is rebranding as MZSoft. These Terms cover your use of the SpeakSense mobile application and any related services we operate under either name.
Acceptance
By downloading or using SpeakSense, you agree to these Terms and any policies referenced here. If you do not agree, do not use the app. If you use SpeakSense on behalf of an organization, you confirm you have authority to do so.
Eligibility and Accounts
SpeakSense does not require you to create an account. You must be legally able to consent to these Terms under the laws of your country or region and the App Store rules that apply to you.
License and Rights
We grant you a personal, non-transferable license to install and use SpeakSense on devices you own or control solely for lawful personal or internal business purposes. You may not copy, reverse engineer, or modify the app except where allowed by applicable law.
Acceptable Use
- Do not record, transcribe, or share content without required consent from participants.
- Do not use the app for unlawful, harmful, or infringing activity.
- Do not attempt to bypass security, interfere with the app’s operation, or misuse system resources.
We may suspend or terminate access for violations.
Your Recordings and Transcripts
Audio recordings and transcripts you create remain yours. They are stored on your device unless you choose to export or share them. You are responsible for complying with local laws, obtaining permissions, and backing up any content you wish to retain.
Purchases
If you buy subscriptions or other paid features, billing is handled by Apple under its own terms. Any free trials or promotional offers are subject to change. We may change pricing prospectively; existing paid periods continue until they expire.
Third-Party Services and Models
SpeakSense relies on Apple-provided services (e.g., App Store billing, system speech/microphone permissions) and on-device speech models such as Sherpa-ONNX. Those services have their own terms and privacy practices.
Updates and Availability
We may update or discontinue features at any time. The app’s performance can depend on your device, OS version, and network availability when you choose to share or download data.
No Warranties
SpeakSense is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee error-free operation or uninterrupted availability.
Limitation of Liability
To the fullest extent permitted by law, Dajiale/MZSoft is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, or loss of data, profits, or goodwill. Our total liability for claims related to the app will not exceed the amount you paid for the service during the twelve months before the claim (or the minimum allowed by law if none was paid).
Indemnity
You agree to indemnify and hold Dajiale/MZSoft harmless from claims, losses, and expenses arising from your misuse of the app, your content, or your violation of these Terms or applicable law.
Changes to These Terms
We may update these Terms. If changes are material, we will provide notice in the app or through the App Store listing. Continued use after changes become effective means you accept the updated Terms.
Termination
You may stop using the app at any time by deleting it. We may suspend or terminate access if you violate these Terms or if we stop offering the app. Sections that by nature should survive (e.g., limitations of liability, indemnity) will continue to apply.
Governing Law
These Terms apply to you to the extent permitted by the laws and consumer protections of your country or region. Venue and dispute resolution requirements provided by the App Store may also apply.
